Agency head and statutory offices excluded from the requirements of the Merit and Transparency policy

The Merit and Transparency policy and guidelines apply only to APS agencies that operate under the Public Service Act 1999.

Apart from the agency heads and other statutory offices detailed below, all current and future APS agency head roles, full-time APS statutory offices and APS statutory offices where there are both full time and part time offices with the same title, are covered by the policy.

• Chief Executive Officer, Australian Customs and Border Protection Service *

• Registrar, Administrative Appeals Tribunal
• President, National Native Title Tribunal
• Registrar, National Native Title Tribunal
• Chief Executive Officer, Federal Court of Australia
• Assessors, Federal Court of Australia
• Chief Executive Officer, Family Court of Australia
• Chief Executive Officer, Federal Magistrates Court ^
• Administrator of the Northern Territory
• Administrator of Christmas and Cocos (Keeling) Islands
• Administrator of Norfolk Island
• Chair, Future Fund Management Agency
• Chairperson, Australian Competition and Consumer Commission
• Council President, National Competition Council
• Deputy Chair, Australian Competition and Consumer Commission
• Member, Australian Competition and Consumer Commission
• Chair, Australian Energy Regulator, Australian Competition and Consumer Commission

• Part-time statutory offices are excluded, other than part-time APS agency head roles, and APS statutory offices where there are both full-time and part time offices with the same title.
• Statutory appointments which require the appointee to be an APS employee (i.e. where legislation requires that a statutory office must be held by an APS employee) are excluded as they are already subject to merit-based selection under the Public Service Act 1999.
