The purpose of this circular is to inform Australian Public Service (APS) agencies that the Governor-General has fixed 1 July 2013 as the day on which Schedules 1, 2, 3 and 4 of the Public Service Amendment Act 2013 (the Act) commence.
The current provisions of the Public Service Act 1999 continue to apply until 1 July 2013.
In addition, Public Service Amendment Regulation 2013 and Australian Public Service Commissioner's Directions 2013 have been made to support relevant provisions of the Act.
Both the Regulation and Directions are disallowable legislative instruments. They have been tabled in each House for consideration over 15 sitting days.
The Australian Public Service Commission (the Commission) will shortly release the following Advices on the changes and the action that agencies need to take by 1 July 2013:
- Secretaries and Secretaries Board
roles and employment matters
Values, Employment Principles and revisions to the Code of Conduct
- Public Service Commissioner's functions (including appointment of Special Commissioners)
- Merit Protection Commissioner's functions
- Handling misconduct (section 15(3) and sanction procedures)
- Recruitment and selection
- Independent Selection Advisory Committees (ISACs)
- Performance management
- Review of action
- Use and disclosure of employee information
- Statutory Office Holders
- Miscellaneous provisions
The Commission will hold an information session for agency human resources and values and conduct areas at the Australian War Memorial on 8 April 2013.
The focus of the information session is the steps agencies need to take to prepare for commencement of the Act on 1 July 2013.
Registration: to register online go to https://apsc.gov.au/Registration, click on Book a Course, select Special Events and then register for the session. Places are limited. Large agencies (more than 3,000 employees) will be able to nominate
a maximum of three (3) attendees. All other agencies may nominate up to two (2) attendees.
Circular 2013/2 provided detailed information on the main features of the Act.
The Commission will provide further information for agencies at the Heads of Corporate forum on 27 March 2013 and the
Leaders forum on 8 May 2013.
Action required now
No specific action to implement the changes is currently required. The Advices will provide information on the steps agencies need to take to prepare for commencement of the Act.
