12. Does an unsuccessful election candidate have a right of return to the APS?

A person who resigns from employment in the APS in order to contest an election prescribed by Regulation 3.13 and is unsuccessful at the election is entitled to be engaged again (section 32). The application for engagement must be made to the Agency Head of the agency in which the person was employed when the person resigned and must be made within the required period (Regulation 3.14).

If the person resigned from ongoing employment, they are entitled to be engaged on an ongoing basis, at their previous classification and to be assigned duties that are the same or similar to their previous duties. If such duties are unavailable, the person must be assigned duties at their previous classification (Regulation 3.15). This issue is discussed in greater detail in Appendix F.
